By using or accessing our website and/or placing any order(s), you agree to be legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions then you may not use or access our website or place orders. These terms relate to sales over the Internet, telephone orders and also personal shoppers.If you have placed an order through this website without checking that the item is available for sale by calling us first then any resultant cancellations will be subject to administrative/bank charge fees from any refund provided.

This website is designed for your convenience and if you have any comments or problems and any questions regarding this site and/or products and services featured on the site, please send an email to info@hampshirebarninteriors.co.uk The contract made by you on-line with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you.

If you have placed an order through this website without checking that the item is available for sale by calling us first then any resultant cancellations/refunds  will be subject to administrative/bank charge fees from any refund provided.

Please read and agree these Terms and Conditions prior to sending to us an online or telephone order and you will not be able to proceed with your purchase until you have read and agreed to these terms and conditions.

1. PRODUCT SPECIFICATIONS

i. We have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to sales.

ii. Products supplied may differ as a consequence from those on display or advertised. Unless otherwise previously agreed with you, the products supplied will be of equivalent value and  functionality.

iii. We endeavour to display as accurately as possible the colours of our products that appear on the website. However we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product delivered.

iv. Wood is a natural product and each piece of our furniture will have a unique character and appearance. All of our furniture is supplied automatically in a dark mahogany colouring but should you require the wood to be stained or painted in a different finish we can accommodate your request. Details of options available can be supplied on request to  info@hampshirebarninteriors.co.uk

v. Each piece of furniture is individually hand carved and carvings and patterns may therefore vary from the photographs shown

If you have any restrictions with regards to measurements please contact us prior to purchase and we can check exact size of the item being dispatched to you to ensure it will fit in any restricted spaces.

2. MADE TO ORDER / BESPOKE FURNITURE and measurements

i. We will not accept any liability for any extra costs incurred by you as a result of incorrect or incomplete measurements or information supplied by you.

ii. All dimensions specified by us are approximate. Each piece of furniture is individually hand made and carved and therefore will be individual and may therefore vary from the dimensions quoted online. Wood is a natural material so there may be some variances in colour and appearance and this is not a fault.

iii. Bespoke furniture and made to order furniture is made specifically for you and therefore ‘personalised’ as recognised by the Distance Selling Regulations. If you need to amend or cancel your order for standard or bespoke furniture, you have the right to do so at any time up to 48 HOURS  after you have placed your order as manufacture has already commenced at that time. Notification must be made to us in writing via email to info@hampshirebarninteriors.co.uk. If you amend your order in any way more than 48 hours after you placed it, we reserve the right to charge you any costs we have incurred in relation to your order. and normally 50% charge at least. Bespoke furniture products or items made to order cannot be returned after you have received them unless they are confirmed as defective or damaged in which case they will be taken away by the delivery service and repaired or replaced at our discretion.

3. PRICES

i. All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.

ii. The prices displayed on the website are for on-line purchases.

iii. The prices displayed on the website in relation to any on-line promotion are valid strictly until midnight on the day on which the promotion expires, as determined by us.

4. PAYMENT

i. You must pay by credit, charge or debit card, bank transfer  at the time of order so long as we have confirmed to you that the item you require is in stock and available for immediate collection OR will be ordered/reserved for you specifically. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website will be correct; that the credit charge or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.

ii. Payment will be taken in full at the time of the order. On rare occasions, if  we have agreed to take a holding deposit this will be forfeited if the order is subsequently cancelled by the customer.

iii. The contract shall not have been concluded until we have received your payment via bank transfer , paypal or a valid credit card  or debit card payment and we have accepted your payment / order.

iv. We are entitled to refuse any order placed by you.

v. The transaction will be handled for you by Streamline Merchant Services . The transaction amount will be paid to Hampshire Barn Interiors Limited.

vi. Title of the goods on any sale shall only pass from Hampshire Barn Interiors Ltd to the customer when the goods have been paid for in full by the customer. On rare occasions, if  we have agreed to take a holding deposit this will be forfeited if the order is subsequently cancelled by the customer within 48 hours.

5. DELIVERY

Delivery will normally be within 3 weeks for items confirmed as being in stock and 12-16 weeks for bespoke or ordered/reserved furniture. As our mahogany furniture is made in Indonesia very occasionally shipping/production delays occur, which are completely outside of our control. We endeavour at all times to fulfill customer orders as quickly as possible

.i. The prices of our furniture online do not include delivery costs . We can supply delivery quotations for you utilising our close connections with reliable independent delivery services.  Excess Delivery charges will be paid by you directly to the delivery company you choose or if you authorise us to collect payment for delivery for onward payment to the third party carrier, it will be deemed that you have paid the delivery company direct. All items leaving our premises are checked to ensure that no defects are present prior to dispatch. Customers can inspect goods personally by appointment prior to dispatch. Liability for damage in transit will become the responsibility of the delivery company you choose. We do not accept liability for damage in transit

ii Non collection  of goods. If we are requested and agree to store items for a purchaser, and if after 3 months of availability the purchaser fails to collect, storage charges will be levied and if after a further 3 months collection has still not been made then the goods will be disposed of, as it will be assumed that the item is no longer required. If we agree to store items on a temporary basis for a customer and the purchase is subsequently cancelled by the purchaser more than 14 days from original date of purchase storage charges will be applied to any refunded payments.

6. DATA PROTECTION

i. Hampshire Barn Interiors Limited operates in accordance with the Data Protection Act 1998 (“the Act”).

ii. We process your personal data in accordance with the Act.

7. RETURNS POLICY

If you have placed an order through this website without checking that the item is available for sale by calling us first then any resultant cancellations will be subject to administrative/bank charge fees from any refund provided.

As stated above a thorough inspection is carried out before any of our items are released for delivery/collection and therefore you can be assured that no known defects are present at this time. Should any defect arise within 7 days of receipt please contact us immediately and we will investigate the problem. Should it be found by us that there is a defect in the production of the item we will exchange the item or refund the value of the item. Liability is limited to the value of the item in question Returns

If you wish to return an item due to unsuitability then in line with the Consumer Contracts Regulations, which implement the Consumer Rights Directive in UK law, you can do so provided you inform us of your decision IN WRITING ( to info@hampshirebarninteriors.co.uk ) within 14 days of receipt. Any notifications outside this 14 day period are not allowable. The item must not be used and must be ‘as new’ when returned to us. Once you’ve informed us IN WRITING that you wish to return goods , you have 28 calendar days to do so, at your own expense. Returns are strictly by appointment as we operate an unmanned warehouse and normally at least 48 hours notice must be given so that we can agree an exact date and time. Once the item is received at Hampshire Barn Interiors, we’ll issue a full refund for the product to your original payment method. Please note the product must still be in its original packaging and unused or claims may be invalid. For all returns, except where the item is faulty, you will be required to pay for the return of the products to us. .Items must be returned to us in a re-saleable and perfect condition and we accept no responsibility for parcels or furniture lost or damaged in transit and a refund will only be made once the goods are received back  and have been inspected by us. The Consumer Contracts Regulations (previously Distance Selling Regulations) , do not apply to returns for business customers, personal shoppers, auction items, items made to order or bespoke items ordered specifically by a customer. If returned items are accepted by us and a credit note is issued no further free deliveries are allowable and replacement new items purchased via credit note  items will be subject to delivery charges. Any item(s)  returned to us with our agreement and exchanged will be subject to redelivery charges as well as the return charges as no further free deliveries allowed.

Consumer Contracts Regulations,(previously Distance Selling Regulations)  do not apply to business/trade/commercial   customers. We shall consider accepting a  return  at our discretion  but all delivery charges incurred by us would be deducted from a Credit Note . No refunds granted.

8. GUARANTEE

All of our furniture products come with a one year manufacturer’s guarantee, covering product replacement or repair only. If within one year of purchase, your product fails due to quality of craftsmanship, please contact our Customer Service Department immediately. We will not accept any item liability for their loss, damage or destruction after they have been delivered.Guarantee Exclusions Normal shrinkage, swelling, cracks and minor warpage on furniture is to be expected and is not a structural defect and is therefore not covered. Proper care and use are essential to preserving your rights under this guarantee. Not suitable for conservatory use or shop window use due to extremes of temperature which can occur. Do not situate mahogany furniture directly by a heat source eg radiators. We will not replace or repair your furniture if improper maintenance or improper use causes damage. This guarantee does not apply if your product is damaged by the use of detergents, abrasives or other harsh cleaning agents. This guarantee does not cover damage resulting from negligence, abuse, normal wear and tear, or accidents: including burns, cuts, scratches, tears, scuffs, watermarks, indentations or pet damage The guarantee does not apply to items offered at discounted levels. In case of a claim, please follow this procedure Please take photos of the damage on the furniture, and send it to info@hampshirebarninteriors.co.uk  in a digitized format to enable us to assess the defect or damage. If the defect or damage passes as a manufacturer’s defect, We will advise you to 1) get an estimate for a repair, or 2) will authorize a replacement.
